Expressions of Interest are invited from suitably qualified Applicants for the works described below. This procurement is subject to the World Trade Organization Agreement on Government Procurement.
1. Background Information
MTR Corporation Limited invites qualified companies to express their interest in tendering for Contract T0988-26C for the provision of all supervision, labour, materials, plant, tools and equipment required for Builder’s Works at several tunnels, stations and trackside areas.
2. Scope of Works
The Corporation is planning to carry out the enhancement and associated installation works for trackside ECS equipment within the designated trackside area. To facilitate the future installation and replacement of ECS equipment by others, the Corporation intends to appoint a contractor to undertake the necessary builder's works. The scope of required services to be provided by the contractor shall generally comprise the following:
a) Site verification, survey, setting out, and investigation works required to confirm existing conditions and interfaces.
b) Temporary works, protection, access arrangements, and any required enabling works to support construction in the trackside environment.
c) Demolition, modification, and removal of existing builder’s works elements, including any obstructions, supports, plinths, bases, trenches, openings, or local structures affected by the ECS works.
d) Construction of new builder’s works to suit the ECS installation, including foundations, plinths, frames, support structures, temporary working platform, cable containment openings, equipment bases, and associated civil/structural works.
e) Making good, reinstatement, and finishing of affected areas upon completion of the ECS works, including restoration of finishes, drainage, access provisions, and any impacted trackside elements.
f) Coordination with the ECS installer, station/depot operations, and interfacing parties to ensure works are properly sequenced and compatible with railway operations.
g) Preparation of method statements, temporary works proposals, construction sequencing, logistics, and safety submissions for the works.
h) Provision of as-built records, completion documents, and handover information for all completed builder’s works.
The duration of the term contract services is 2 years.

4. Expressions of Interest

5. Deadline to Return Answers / Information
Applicants will receive a prequalification invitation via the E-Tendering System. The Applicants shall complete and submit all required information and details via the E-Tendering System no later than the time and date specified in the prequalification invitation letter.
All invitations and submissions for prequalification will be carried out through the E-Tendering System at http://www.hkextender.com.
6. Other Matters
Applicants responding to this advertisement are deemed to have complied with the Personal Data (Privacy) Ordinance in the collection and transfer of personal data to MTR Corporation Limited. All information submitted including personal data, will be used by MTR Corporation Limited for the prequalification of tenderers for this project.
Applicants shall note and make themselves aware of the Corporation’s ethical and probity requirements which shall be applied throughout the tender and contract periods. Further, Applicants shall not, and shall ensure that its directors, employees, agents and sub-contractors shall not, offer or give any advantage as defined in the Prevention of Bribery Ordinance (Cap. 201) to any employee or agent of MTR Corporation Limited. Any breach or non-compliance with this paragraph by the Applicant shall, without affecting its liability for such breach or non-compliance, result in its application not being considered.
Applicants shall not apply for prequalification as an entity if they intend to act as a supplier, sub-contractor or sub-consultant for another entity who will also apply for the prequalification, or if they are a partner in a joint venture established to seek prequalification for this Contract.
Companies having linkage to each other, e.g. subsidiaries, holding or sister companies, shall not apply for prequalification as a tenderer for the same contract, whether as a single entity or as a partner of a joint venture. “Sister company” shall mean all companies which are subsidiaries of or otherwise belonging to the same holding company. The existence of a holding-subsidiary relationship shall be determined in accordance with the provisions in Sections 13 to 15 of the Companies Ordinance (Cap. 622) of Hong Kong. Companies having linkage to each other shall elect which company shall apply for prequalification.
The Corporation reserves the right to conduct negotiation with shortlisted tenderers or with the tenderer who submit the lowest price technical compliant tender on the technical and financial terms of the tender offer(s). Such negotiations may be conducted through e-auction or other appropriate methods as determined by the Corporation.
